South African Maintenance Courts are failing families - it’s time for change

The South African judicial system created Maintenance Courts to handle cases related to financial support for dependents.

Maintenance Courts should ensure that individuals who are legally obligated to provide financial support fulfill their duties. Unfortunately, South African children are being failed by Maintenance Courts.

Magistrate’s courts dealing with maintenance issues are usually understaffed, underfunded, inefficient and the staff poorly trained.

More than 48% of children in South Africa live with only one parent and more than 90% of maintenance defaulters are men.

“We need to shake up the system in the courts. It is still the women who must be victims, and it costs them in pay, work and transport.”

If you and your children have been failed by a Maintenance Court and you can prove that you and the children suffered damages as a result thereof, justice needs be done.
